District Court Closes the Door Permanently on Wickfire’s Meritless Claims

After Wickfire suffered a devastating loss at the Fifth Circuit Court of Appeals, Wickfire nonetheless continued pursuing meritless claims at a District Court. The District Court rejected Wickfire’s attempts and dismissed Wickfire’s claims permanently. This ends Wickfire’s eight-year lawsuit and provides TriMax with complete vindication

AUSTIN, Texas, April 04, 2022 (GLOBE NEWSWIRE) — Wickfire suffered the latest in an extensive line of litigation defeats to TriMax. This time, a District Court dismissed Wickfire’s meritless claims permanently.

In 2021, an Appellate Court ruled that Wickfire lacked any evidence supporting its multi-million-dollar claims against TriMax. Undeterred by this monumental loss, Wickfire tried its hand once more and failed.

After losing at the Appellate Court, Wickfire moved a District Court to order TriMax pay Wickfire more than $400,000. This led to a flurry of findings and orders against Wickfire:

  • In February 2022, Federal Magistrate Judge Susan Hightower found that Wickfire’s motion lacked merit. In reaching her determination, the Magistrate Judge recognized “excessive costs and delays” due to Wickfire’s “litigation tactics.”
  • After that, United States District Judge Robert Pitman issued an Order agreeing with the Magistrate Judge’s findings and fully denied Wickfire’s motion.
  • On March 15, 2022, the Western District of Texas issued a Final Judgment, finding that Wickfire shall “TAKE NOTHING” on all its claims against TriMax and its principals.
  • In the same “TAKE NOTHING” judgment, the District Court declared that Wickfire’s claims shall be “DISMISSED WITH PREJUDICE,” thereby preventing Wickfire from continuing to assert its meritless claims against TriMax in the future.

The orders and findings appear in published opinions from the Fifth Circuit Court of Appeals, Case Number 17-3043040 and the United States District Court for the Western District of Texas, Case No. 1:14-CV-0034-RP.

The lawsuit centered around Google AdWords Auctions, an online-auction platform where companies like TriMax and Wickfire compete for advertising space. Wickfire asserted a series of claims against TriMax, but as to each one, Wickfire failed. Wickfire alleged TriMax intentionally interfered with Wickfire’s contracts, intentionally interfered with Wickfire’s prospective business, and committed civil conspiracy. An Appellate Court found “Wickfire offered no such proof” and declared that each of these claims failed.

After the Appellate Court found an earlier District Court judgment awarding $2.3 million to Wickfire to be erroneous due to the lack of any supporting evidence, the District Court more recently issued the “TAKE NOTHING” judgment. Through the “TAKE NOTHING” judgment, Wickfire received no award and, conversely, was ordered to pay its own attorneys’ fees and costs.

In the same lawsuit, the jury previously found Wickfire LLC and its co-owners, Chet Hall and Jon Brown, to have intentionally interfered with TriMax Media’s business. TriMax argued that Wickfire intentionally interfered with TriMax’s contracts by (1) paying kickbacks to merchant representatives in exchange for exclusivity agreements; (2) impersonating TriMax by placing unauthorized ads that plagiarized TriMax’s ad copy and contained other identifying information of TriMax; (3) repeatedly clicking on TriMax ads in order to artificially increase TriMax’s costs (known as “click fraud”); and (4) using an automated software program to manipulate the Google auction system (known as “bid jamming”).

TriMax presented evidence to the jury that Wickfire had been suspended from over 200 Google accounts, violated merchant terms, and employed fake user agents and proxies to conceal its identity. The jury also saw evidence that Google referred to Wickfire as “Known Fraudsters” and that Wickfire registered the domain name “GoogleClickFraud.com”.

TriMax also presented evidence regarding Wickfire’s destruction of evidence. During the litigation, Wickfire wiped all the data from its Chief Technology Officer, Jon Brown’s, laptop and then failed to disclose that information to TriMax or the District Court. Once TriMax uncovered the destruction, Wickfire claimed it was necessary, since the laptop had been stolen during a home burglary. However, the police report—which TriMax obtained independently after Wickfire failed to produce a copy—contradicted Wickfire’s story because it mentioned nothing about an allegedly stolen laptop.

While the jury heard extensive evidence about Wickfire’s conduct comprising Wickfire’s intentional interference against TriMax (which the jury found to have occurred), some of the most devastating evidence was excluded. For example, the jury was not permitted to see:

  • The police report from the burglary;
  • Registration documents showing Wickfire as the owner of “BitchesOfFacebook.com” and “PokeBitches.com”;
  • An e-mail from a merchant representative who, after refusing to accept the alleged kickbacks, referred to Wickfire as “criminals”;
  • Screenshots of Wickfire’s ads impersonating TriMax’s;
  • An e-mail from a merchant terminating TriMax after wrongly believing TriMax was the source of the impersonating ads;
  • An e-mail from a merchant complaining that Wickfire violated trademark terms and plagiarized TriMax’s ads;
  • A lengthy technical report that, according to a world-renowned computer expert, proves conclusively that Wickfire committed extensive click fraud against TriMax;
  • A real-time video demonstrating the bid-jamming TriMax experienced;
  • A summary of hundreds of TriMax’s merchant contracts interfered with by bid-jamming; and
  • E-mails from other competitors of Wickfire complaining about Wickfire’s bidding tactics.

Despite the jury’s finding against Wickfire, Chet Hall, and Jon Brown for intentional interference with TriMax’s business, no damages against Wickfire were awarded. This was, as the District Court noted, a finding reached by the jury after “the jury heard evidence that Google investigated Wickfire’s AdWords bidding and determined it was permissible.”

However, the District Court’s Final Judgment did not disturb the jury’s finding that Wickfire, Chet Hall, and Jon Brown committed the intentional interference in the first place. Thus, the interference finding against Wickfire, Chet Hall, and Jon Brown stands and is final.

Prior to issuing the “TAKE NOTHING” judgment and dismissing Wickfire’s meritless claims permanently, a Magistrate Judge considered a motion to disqualify Wickfire attorney, Katy Hall (formerly known as Katy Atlas). TriMax alleged that while in possession of TriMax’s sensitive documents, Katy Hall began a personal and intimate relationship with Chet Hall (CEO and Co-Founder of Wickfire, and, himself a party to the case), divorced her prior husband, had a child with Chet Hall, and married Chet Hall after he divorced his prior wife. TriMax also alleged that Katy Hall wrongfully accepted an in-house position with Wickfire while in possession of the documents. Katy Hall is currently Chief Operating Officer of Wickfire’s BuyersGuide.org. A Magistrate Judge however, ruled that TriMax could not “meet its heavy burden to prove that disqualification is warranted” and denied the motion to disqualify Katy Hall.

Nevertheless, based on the jury’s finding that Wickfire interfered with TriMax’s business—a finding that was not reversed or altered by the recent Final Judgment—we now hope tactics like impersonation of competitors, kickbacks, bid jamming, and click fraud, will no longer be tolerated in the online advertising industry.”

1,500 Pastors Gather for Shincheonji Church Press Conference

WHO says 99% of world’s population breathes poor-quality air

Washington, The U.N. health agency says nearly everybody in the world breathes air that doesn’t meet its standards for air quality, calling for more action to reduce fossil-fuel use, which generates pollutants that cause respiratory and blood-flow problems and lead to millions of preventable deaths each year.

The World Health Organization, about six months after tightening its guidelines on air quality, on Monday issued an update to its database on air quality that draws on information from a growing number of cities, towns, and villages across the globe — now totaling over 6,000 municipalities, said AP.

WHO said 99 percent of the global population breathes air that exceeds its air-quality limits and is often rife with particles that can penetrate deep into the lungs, enter the veins and arteries, and cause disease. Air quality is poorest in WHO’s Eastern Mediterranean and Southeast Asia regions, followed by Africa, it said.

“After surviving a pandemic, it is unacceptable to still have 7 million preventable deaths and countless preventable lost years of good health due to air pollution,” said Dr. Maria Neira, head of WHO’s department of environment, climate change and health. “Yet too many investments are still being sunk into a polluted environment rather than in clean, healthy air.”

The database, which has traditionally considered two types of particulate matter known as PM2.5 and PM10, for the first time has included ground measurements of nitrogen dioxide. The last version of the database was issued in 2018.

Nitrogen dioxide originates mainly from human-generated burning of fuel, such as through automobile traffic, and is most common in urban areas. Exposure can bring respiratory disease like asthma and symptoms like coughing, wheezing and difficulty in breathing, and more hospital and emergency-room admissions, WHO said. The highest concentrations were found in the eastern Mediterranean region.

Particulate matter has many sources, such as transportation, power plants, agriculture, the burning of waste and industry – as well as from natural sources like desert dust. The developing world is particularly hard hit: India had high levels of PM10, while China showed high levels of PM2.5, the database showed.

The findings highlight the sheer scale of the changes needed to combat air pollution, said Anumita Roychowdhury, an air pollution expert at Center for Science and Environment, a research and advocacy organization in New Delhi.

India and the world need to brace for major changes to try to curb air pollution: electric vehicles; a shift away from fossil fuels; a massive scaling-up of green energy; and households separating their types of waste, she said.

The Council on Energy, Environment and Water, a New Delhi-based think tank, found in a study that more than 60% of India’s PM2.5 loads are from households and industries.

Tanushree Ganguly, who heads the council’s program on air quality, called for action toward reducing emissions from industries, automobiles, biomass burning and domestic energy.

Sudan’s Al-Burhan urges UN mission’s neutrality on national political crisis

KHARTOUM, Chairman of Sudan’s Transitional Sovereign Council Abdel Fattah Al-Burhan called on the UN Integrated Transition Assistance Mission in Sudan (UNITAMS) to keep the same distance from all parties amid the ongoing political crisis in the country.

His remarks came during a meeting with the head of UNITAMS Volker Perthes in the capital Khartoum, where Al-Burhan questioned the scope of a recent UNITAMS briefing on Sudan to the UN Security Council (UNSC), according to a statement by the sovereign council.

“The briefing did not cover all situations in the country and not include the positive indicators that occurred on the ground,” Al-Burhan was quoted as saying.

Perthes, for his part, said his briefing was based on the information and reports prepared by his office in Khartoum, according to the statement.

The UN envoy, however, voiced readiness to review any inaccurate information contained in the report submitted to the UNSC.

The meeting came a day after Al-Burhan warned that if the UN mission goes beyond its mandate or interferes in Sudan’s internal affairs, Perthes could be expelled.

In last week’s briefing to the UNSC, Perthes cautioned that the deteriorating economic, humanitarian and security situations in Sudan were due to the absence of “a functioning government” since October 2021 and the “violent repression” against the protesters demanding civilian rule.

On Jan. 10, the UNITAMS launched an intra-Sudanese political process to end the country’s political crisis. Perthes has since been in consultations with Sudanese political parties and civil forces in the country.

Recently, the African Union joined the UN efforts seeking to reach a political settlement in Sudan.

Sudan has been suffering a political crisis after Al-Burhan, general commander of the Sudanese Armed Forces, declared a state of emergency on Oct. 25, 2021 and dissolved the Sovereign Council and the government.

Since then, Khartoum and other cities have been witnessing continued protests demanding a return to civilian rule.

Rwandan Court Refuses to Lengthen Sentence of ‘Hotel Rwanda’ Hero

The Rwandan man portrayed as a hero in the movie “Hotel Rwanda” should not have his 25-year sentence extended to life in prison, a Rwandan court ruled Monday.

Paul Rusesabagina was convicted in September on eight terrorism charges for his role in a group opposing President Paul Kagame.

Rusesabagina said that he was a leader in the Rwanda Movement for Democratic Change but had no role in the group’s armed wing, the National Liberation Front, which has carried out attacks.

He refused to take part in the September trial, calling it a sham, and was not present at Monday’s ruling.

Prosecutors called the 25-year sentence too lenient.

His family has lobbied for his release, saying he is ill.

Rusesabagina saved around 1,200 people by sheltering them in a hotel during the country’s 1994 genocide, which saw over 800,000 killed.

The Darien, a Gap between Hope and Despair

San Vicente, With a bag full of hopes and dreams, Iriana Ureña, a 32-year-old Venezuelan mother of two, arrived at a Migrant Reception Station (ERM) in San Vicente, at the edge of the Darien Gap. The look in her eyes showing the pain of a mother who would do anything to protect her children.

Iriana and her husband Eduardo decided to take the journey north from Venezuela through the jungle with their two children in search of better opportunities. The decision to leave their country, home, family, friends, and a life’s work to start all over again was a difficult but necessary one for them and many other migrants. They were hungry, dehydrated, and exhausted upon arrival at the station.

“The road was not easy, I felt that our lives were in danger. It was challenging because we saw very ugly things along the road, things that I would never think I would see in my life,” said Iriana.

According to statistics from Panama Migration Services, nearly 134,000 people, 80 per cent of whom were Haitians, risked their lives through the dense jungle in 2021. This is a record number of people crossing the 10,000 square mile rectangle of trackless jungle, rugged mountains, turbulent rivers, swamp, and deadly snakes that spans both sides of the border between Colombia and Panama. Today, the journey through the gap is made more perilous by criminal groups and smugglers who control the region, often extorting and sometimes sexually assaulting migrants.

However, the dynamics are changing as the jungle no longer sounds Creole. The Haitians, who used to cross this dangerous trail in masses are no longer the majority. They are still trying to get from Colombia to the United States, but Spanish and the resounding “panas” of the Venezuelan migrants now prevail on the trail.

The numbers of Venezuelans crossing the Darien Gap in the first two months of 2022 (some 2,497) almost reached the entire total for 2021 (2,819), becoming the main group crossing the heart of the rainforest. But this list also includes Cubans, Haitians, Senegalese, and Uzbek nationals, among others.

Scaling up aid

Emerging from the gap, most migrants pass through the Bajo Chiquito or Canaan Membrillo communities before making their way on foot or by community boats along the muddy waters of the Chucunaque River. The probability of suffering physical and psychological violence is very high throughout the whole journey.

The International Organization for Migration (IOM) works with the government in coordination with other agencies to provide assistance to people in transit and host communities.

“Responding to the needs of migrants transiting irregularly through Panama poses significant challenges mainly related to funding,” says Santiago Paz, Chief of IOM Panama and Head of the Panama Global Administrative Center (PAC). “In this sense, there is an urgent need to redouble coordination between governments and international cooperation to respond to the humanitarian needs of the population in transit.”

In recent years, the Panamanian government has put in place infrastructure to temporarily house the population in transit and attend to the humanitarian needs of this growing migrant population. With technical support from the IOM and other international organizations, Panama has installed three ERMs, where migrants find lodging and food, and where potential cases of COVID-19 are monitored.

Among the newly arrived migrants is Johainy, a Venezuelan mother, and her one-year-old baby.

“We faced a lot of difficulties, we were robbed, and saw dead people along the way. Though we prepared ourselves as much as we could watching many videos about the route, nothing could totally prepare us for what we experienced in the forest.”

Mariel Rodriguez, Cultural Promoter for IOM Panama based in Darien, works with the migrants. She walks around the centre to provide migrants orientation and information. “The migrants we assist in the ERM are in a situation of extreme vulnerability and have very varied needs, from knowing in which country they are arriving, to medical assistance, clothes or basic hygiene products. The IOM team responds to these needs and coordinates with other government agencies and institutions to ensure access to available services.”

With a population of around 7,000 people, Meteti town has swollen in recent years with migrants – mostly Venezuelans, like Iriana, as well as Cubans, South Americans, Africans, South Asians, and others, all aiming for the United States or Canada.

IOM has balanced the needs of both migrants and host communities at the Panama-Colombian border with financial and policy support. This has reduced migrants’ vulnerability and assisted those who welcome them.

Getting beyond the gap in search of a better life

For thousands of migrants around the globe the perilous, roadless jungle becomes a path of desperate hope to the north in search of a better life. A babel of languages mixes in the vast jungle, from where some never emerge alive, though the death toll is unclear. They come from Haiti, Venezuela, Cuba, but also many countries in Africa and Asia. Many often passed through South American countries after working for months or even years.

Migrants continue to stream through the Darien Gap, many with stories or signs of trauma, like Shahzad from Pakistan (“We found dead bodies and skulls during the walk”) or Esther, who arrived extenuated, with blood-blistered feet, and hand carried by other people.

Others arrived with stories of hope. “The hike was extremely hard. I went into labour and I had my baby Hamdi in the middle of the forest with the only help of my husband. I had to drink water from the river for days. However, the newcomer gave all the family a renewed sign of hope I did not expect,” said Bijou Ziena Kalunga, 33, from the Democratic Republic of the Congo.

Or tears of joy as families are reunited after several days apart in the jungle, like Venezuelan William, Jorgeis and a six-month-old baby. “I was really sad, and I kept praying for my husband to arrive. I can´t say how happy I am to have him back,” Jorgeis said.

In the reception station, migrants crowd around every available electrical socket, charging their phones while they type on WhatsApp to loved ones back home. They talk about their hazardous way through the forest and their plans and hopes for the future.

Serigne Nor Sarr, 33, has modest ambitions. “My hope for the future is to work, start a family and lead a very simple life,” he said, standing outside his temporary shelter. The young Senegalese man has already spent more than four years in Brazil where he worked to get enough money for the trip. “We were treated well there,” he said, “but I always planned to leave someday for my dream destination in the United States.”

It’s a dream shared by thousands who arrive in Meteti – a place where some of the world’s hardest stories meet some of the world’s kindest hearts. “The risk is worth it, if it means that I can reach the United States and start over a new life with my family,” whispered Iriana with a hopeful look.
